Welcome to 911FIX. By engaging our services, you agree to the following Terms of Service. These terms are designed to ensure a professional, secure, and efficient relationship between 911FIX (“we,” “us,” or “our”) and our clients (“you”).
1. Services Provided
911FIX provides professional web services, including but not limited to:
- Website Repairs & Troubleshooting: Fixing bugs, broken layouts, and functional errors.
- E-commerce Solutions: Repairs and optimizations for Shopify, WooCommerce, and other platforms.
- Speed Optimization: Enhancing page load times and Core Web Vitals.
- Web Development: Building new websites and custom features.
- Security & Recovery: Malware removal and restoration after crashes.
2. Payment Policy: Paid in Full
To maintain our rapid response and emergency availability:
- Advance Payment: All services must be paid in full prior to the commencement of any work.
- Work will not be scheduled or started until the payment has been processed and cleared.
3. “No Fix, No Fee” Policy
If we are unable to resolve the specific issue for which you hired us after exhausting all reasonable technical avenues, you will receive a full refund.
- Exclusion: This policy is void if the fix is prevented by third-party limitations (e.g., your host refuses to grant access) or if the client fails to provide the necessary credentials or information required to complete the repair.
4. No Refund Policy (Post-Delivery)
- Final Sale: Once a service has been delivered, implemented, or performed on your website, no refunds are allowed.
- Due to the digital nature of our work, the service is considered “consumed” once the solution is delivered.
5. 30-Day Service Guarantee
All repairs and optimizations come with a 30-day guarantee:
- If the exact same issue recurs within 30 days of the delivery date, we will repair it at no additional cost.
- This guarantee is strictly limited to the specific issue originally addressed. It does not cover new bugs, client-induced errors, or third-party updates.
6. Data Loss & Cybersecurity Disclaimer
While we perform our services with the highest level of professional care and “the best humanly possible” effort:
- No Liability for Data Loss: 911FIX is not liable for any loss of data, files, or database corruption. Clients must have a full backup before work begins.
- Cybersecurity Waiver: 911FIX is not responsible for any vulnerabilities, cybersecurity breaches, malware, ransomware, or any other malicious infections that may occur before, during, or after the website repairs.
- No Security Warranty: Repairing a specific issue does not imply that the entire website is “secure” or “immune” to future attacks. We are not liable for any malicious activity that occurs as a result of existing or future vulnerabilities in your software, server, or third-party plugins.
7. Scope of Work & Professional Limitations
- Strict Scope Adherence: Repairing a website does not constitute consent to fix visual elements, perform software upgrades, or execute tasks that are not necessary for the specific repair.
- Work Order Only: We are only responsible for tasks explicitly described in the written Work Order or Invoice. If a task is not listed in the invoice, it is not included in the service and will require a separate agreement and payment.
8. Post-Service Security & Hygiene
- Password Responsibility: Upon completion of service, it is the Client’s sole responsibility to change all passwords provided to 911FIX.
- Access Removal: We recommend removing 911FIX administrative access once the project is confirmed complete.
9. Anti-Abuse & Project Abandonment
- Scope Creep: Additional “small fixes” outside the original invoice will require a new service agreement.
- Abandonment: Projects delayed for more than 14 days due to lack of client response will be marked as “Abandoned” and may require a reactivation fee.
- Interference: If a third party modifies the site while we are working on it, our guarantee is voided.
10. Limitation of Liability (FTC Compliance)
- 911FIX is not liable for indirect, incidental, or consequential damages, including loss of revenue, SEO rankings, or business interruption.
- Our maximum liability shall not exceed the total amount paid for the specific service in question.
11. Privacy
Please review our Privacy Policy regarding your data at: https://www.911fix.com/privacy-policy/
12. Governing Law & Jurisdiction
This Agreement is governed by the laws of the State of Florida. All parties agree that the exclusive jurisdiction for any legal action shall be in the federal or state courts located in Miami-Dade County, Florida, United States.
